TOWN OF BUXTON ZONING ORDINANCE ARTICLE 13 - LAND DEVELOPMENT AND SUBDIVISION STANDARDS 13.6 Performance Guarantees. 13.6.A.4. An offer of conditional approval limiting the number of units built or lots sold until all required improvements have been constructed. The conditions and amount of the performance guarantee shall be determined by the Board with the advice of the PublicWorks Director, Municipal Officers and/or Town Attorney. The performance guarantee shall be for a term not less than three (3) years and shall not expire between October 30 and April 15. The developer shall renew the performance guarantee if development is not complete after three (3) years. If the developer does not renew the performance guarantee, the developer shall be subject to fines as stated in Article 5.3. No signed subdivision plans shall be released or recorded, and no building permits of any kind shall be issued until a performance guarantee has been accepted by the Town.
